Planning Applications

The parish council is not a planning authority and as such does not make final decisions on planning applications; this is the responsibility of Mid Sussex District Council. However, the parish council is a statutory consultee and as such receives all planning applications relating to the parish for comment; it is also able to request and comment on any application made within the District.

Each week the parish receives a copy of the ‘weekly list’ which details all applications received in the District and also a copy, including plans etc, of any applications relating to Lindfield Rural area. The local newspaper, Mid Sussex Times, also lists planning applications. The ‘weekly lists’ and the current planning applications can be viewed at the Parish Council Office or on the Mid Sussex District Council web site at www.midsussex.gov.uk.

Listed below are the most recent planning applications relating to the parish and any comments made by the Parish Council; decisions made by Mid Sussex District Council can be viewed on their web site or, if available, at the Parish Office.

Removal of existing garage base and erection of new double garage for the existing bungalow. Re-organisation of the existing nursery including: Removal of existing polytunnels and timber shed. Erection of entrance canopy. Erection of 6 bay steel glasshouse to form sales, display and inside growing areas together with office accommodation and toilets, and 3 bay glasshouse to form further inside growing areas, also erection of single storey timber clad storage barn. Erection of single storey building to form a farm shop building. (Amended plans and further details received 17/12/2009, which also includes the deletion of the independent access to bungalow)Members felt that the proposals were tantamount to establishing an overdevelopment of the site, but concluded that the enhanced features within this area would be of benefit to the community. It was proposed to accept the application subject to Highways approval of access and signage. This is a very busy and dangerous section of the A272 and Highways needs to give the matter of substandard visibility serious regard.

LR/09/02987/FUL
Renkum Stud, Scaynes Hill Road, Lindfield, RH16 2QG
Provision of stud staff cottageThe Parish Council has examined this application (in line with the previous application) and still considers this to be a progressive urbanisation to the detriment of the countryside. Moreover, this application is clearly for the development of a new residence – beyond that of an employee’s accommodation - so changes the tenor of this application from the original. We are therefore unable to support this application.
21/10/09
LR/09/02950/FUL

LR/09/02973/LDC
4 Orchard Close, Scaynes Hill, RH17 7PQ
Single storey rear extension under monopitch tiled roof. This is an application to establish whether the proposed development is lawful: this will be a legal decision where the planning merits of the proposed development cannot be taken into account‘Members are unable to comment and would look for MSDC guidance regarding the lawful nature of the proposed development. For this application Members feel that the LPA may need to consider that the adjacent property, no 3 Orchard Close, lies considerable lower and the proposed brick wall is adjacent to the boundary fence, dwarfing the site and effecting the outlook of the occupiers in no. 3, including loss of light.’

LR/09/02891/FUL
Scaynes Hill Nursery, Lewes Road, Scaynes Hill, RH17 7NG
Removal of existing garage base and erection of new double garage together with the re-establishment of the former vehicular access to the driveway serving the new garage associated with the existing bungalow. Reorganisation of the existing nursery including: removal of existing polytunnels and timber shed. Erection of entrance canopy. Erection of 6 bay steel glasshouse to form sales, display and inside growing areas together with office accommodation and toilets, and 3 bay glasshouse to form further inside growing areas, also erection of single storey timber clad storage barn. Erection of single storey building to form a farm shop building.Council is aware that the Nursery is in need of some regeneration and an upgrading of facilities would be welcome. However, Council concluded that it will not support this application, as proposed, for the following reasons: Traffic, substandard visibility along the A272. Overdevelopment of the site, Refreshment area conflicts with policies C1 and T4 of MidSussex Local Plan. Full response can be viewed in the parish office or at MSDC.

Conversion of existing rural building to B1 and associated storage useMembers object. Existing gateway visibility splay insufficient for two cars to pass, proposed roadway too narrow, porous gravel surface noisy to neighbours. Plans show existing yard area with ash base which is not apparent visually. No windows should be overlooking the neighbouring houses. No detailed plans regarding disposal of waste/water from rest room/toilets. If planning permission granted, there should be strict control on type and use of offices. Boundaries not defined on plan

Pegden Lodge, Nash Lane, Scaynes Hill, RH17 7NJ
Erection of green oak 2 bay garage and single bay sized workshop with storage above garage. This proposal, by virtue of its design and size is not appropriate to its setting. The proposed garage is too high and imposing as the present house is only one storey high. It conflicts with Policies B1 and H13 of the Mid Sussex Local Plan. Members recommend refusal.

The Willows, Church Road, Scaynes Hill, RH17 7NH
Ground floor flank extension to existing dwellingParish Councillors visited the site to view how far the proposed extension would be located in relation to the boundary and the road. Members were content that the extension was sufficiently removed from the road edge as to not cause a hazard, so therefore we have no objection.

Overhead line at Pellingford Brook and Clear Water Pond, Blackbrook Lane, Scaynes Hill
Re-conduct and refurbish existing overhead line with Compact Covered ConductorThe only objection from the Parish Council is that the Electricity Authority should endeavour, as a policy, to ensure that all cables are located sub surface. Councillors feel that the proliferation of cabling in our towns and countryside is an eyesore and should be eradicated where possible.

2 Chailey Glimpse, Church Road, Scaynes Hill, RH17 7NY
Extension to first floor at rear of buildingThe semi-detached dwellings are flanked on both sides with houses having substantial extensions on two floors. If this application succeeds 1 Chailey Glimpse would be totally marginalized and substantially overshadowed with restricted view from the 1st floor rear and severe light reduction to roof lights. This overdevelopment would adversely affect the environmental wellbeing of 1 Chailey Glimpse. This application is rejected in its present form and it is suggested MSDC officials visit

Springfield Farm, Lewes Road, Scaynes Hill, RH17 7NG
Retrospective application for conversion of redundant buildings and their use within classes B1 and B8, the relocation of building 3 and the provision of a customer display area in Unit 1A. Erection of an infill extension to Unit 1A. Alterations to the access and provision of parking. The Parish Council is not keen to encourage the proliferation of mini industrial estates in rural areas but as this development is located in a discrete area and there is no evidence to suggest that they intend to expand the building works, this element can be accepted. We would not recommend acceptance, however, if it was intended to create additional buildings or store plant and machinery on site. The vehicular access to this site has always been a problem.

River Cottage, Ardingly Road, Lindfield, RH16 2QY
Demolition of existing garaging and replacement with traditional oak framed garage with loft room overParish Councillors have again viewed the proposed planning application and still consider that this is an inappropriate development. The applicant is proposing to replace a small dilapidated garage (now demolished) with a large two storied residence. Not only would it detract from the elegance of the main house but would be regarded as an overdevelopment of the site. We recommend that MSDC once again reject the application.

Adjacent areas for informal recreation and wildlife reserve to be secured by Section 106 AgreementThe Parish Council strongly OBJECT to the whole principle of this land being developed for residential purposes and request the District Council to REFUSE this application as unacceptable on the grounds of planning policy, access, and landscape impact, and also as piecemeal and premature in the light of emerging new policy guidance in the Core Strategy

Removal of existing garage base and erection of new double garage together with formation of new vehicular access to driveway serving new garage associated with the existing bungalow. Reorganisation of the existing nursery including: removal of existing polytunnels and timber shed. Erection of entrance canopy. Erection of 6 bay steel glasshouse to form sales, display and inside growing areas together with office accommodation and toilets, and 3 bay glasshouse to form further inside growing area, also erection of single storey timber clad storage barn. Erection of single storey building to form the refreshment area. The Council is aware that the nursery at Scaynes Hill is in need of some regeneration. The provision of a refreshment building is of concern - it is hoped that the facility will remain a nursery as opposed to a Garden Centre. There is also strong concern over access to a very busy and dangerous section of the A 272 and it is hoped that Highways will give this matter serious regard. The Council is not against the concept of upgrading the site but with due attention to the matters raised

Land adjacent to Gravelye Cottage, Gravelye Lane, Lindfield, RH16 2SN
Erection of a detached dwellingTwo Councillors again visited the site and also viewed our previous submission and have concluded that there is no evidence to suggest that we should amend our views. We regard the proposal as a gross overdevelopment of the site with the only vehicle access on to a bridleway. Although it would appear, by default, that the other two residents have been allowed vehicle access over the bridleway, we suggest that vehicle access should not be allowed to other bridle path users

(Revised description and revised DAS received 27/01/2009)The Parish Council is not in favour of approving the building of houses in the gardens of existing houses so therefore we are recommending to MSDC that this application is rejected on the grounds that it is an over development of the site.

8 Cripland Close, Lindfield, RH16 2SQ
Proposed extension at first floor at the rear of the propertyThis is the applicant’s third attempt to extend their property by adding an additional floor to an existing large extension. Although the provision of windows on the 1st floor facing west has been withdrawn within the present application, the high window on the south facing 1st floor would be an intrusion to residents in Lawrie Lane and in William Allen Lane. This is a large extension regarded as an intrusive edifice to the surrounding area and an overdevelopment of the site. Recommend rejection

Scamps Hill, Scaynes Hill Road, Walstead, RH16 2QQ
Change of use from paddock to residential and erection of one four bedroom chalet style dwelling houseThe Council is concerned that the applicant proposes to build on green belt land. There has already, in our view, been an overdevelopment of the site and to build this house would further exacerbate the situation. We wish to discourage the building of dwellings in a green field site within the strategic gap, Policy C2 of the Mid Sussex Local Plan and Policy CH6 of the West Sussex Structure Plan Deposit Draft, and hope we are supported in this by MSDC.

3 Lawrie Lane, Lindfield, RH16 2SG
Proposed ground floor front and rear extension and alterationsThe Council conclude following consultation: (a) The proposed development is substantial and considered an over-development. (b) The increased hard-standing area could seriously undermine drainage spread and disrupt the delicate drainage position leading to more flooding problems. (c) The development would not be in keeping with surrounding properties, therefore failing to enhance the appearance of the area. The Council recommend that MSDC reject the application in its present form and size.

Land adjacent to Gravelye Cottage, Gravelye Lane, Lindfield. RH16 2SN
Demolition of a double garage serving Gravelye Cottage and erection of new detached cottage style dwelling house with garaging and the erection of a new detached single garage to serve Gravelye CottageParish Councillors have viewed the proposed planning application and consulted local residents. Gravelye Cottage and Overmist (semi detached houses in the same location) are both on the same bridle path and contribute substantially to traffic on the path where pedestrians, horses etc should have free access. This application is regarded as an overdevelopment of the site. The area is critical with regard to drainage and Council sees no evidence that this element has been considered.

Change of use relating to redundant farm buildings to office use (B1)/land and retrospective consent relating to remedial and improvement works/resiting of cart shed. The Council strongly recommends refusal. The change of use from farm buildings to office use (B1)/land introduces an unacceptable urban form in this rural location, to the detriment of the rural character of the area. Members do not consider that there is a need for a rural mini industrial estate. We therefore conclude that the proposal would detract from the countryside and conflicts with Policy C1 and C13 of the Mid Sussex Local Plan.

Change of use with building work from redundant barn to office B1 use with car/van parking using new access and closing 2 existing access pointsThis is the third such application and Council feels that nothing has materially changed to soften our view. It is true that efforts have been made to refurbish the prefabricated structures on site but our other objections are still in place in that we object to the extension of industrial building, thereby attempting to create a mini industrial estate in a rural area. Additionally, despite the change of exit from the site there are still blind sightlines on to a very busy road (60mph).

Close off existing entrance and construct new 2m high brick wall. Change of use of paddock to residential garden area. Use existing paddock entrance to form improved driveway to property.Members have considered this application and object to this proposal on the following basis: a) By creating the entrance to the property over pastureland (greenfield) the area would be reclassified as a brownfield site being withint the boundary of the house. b) Council feels that vehicular access to the house should not be created over pastureland.

two storey side extension and single storey rear extension. The Council has no objection to this proposed planning application except we would need to be assured that the foul waste system is adequate. Proposed 1 and 2 storey building providing 70 bed residential care facility (C2), with live-in staff and manager accommodation, associated car parking and landscaping. Removal of existing buildings, hardstanding and uses.Summarize: Development too large for the rural nature of area. Small site for development, small number of car parking spaces. Poor vehicular access. Narrow country lanes be difficult to sustain increase in traffic. Council objects as it conflicts with the MSDC Local Plan and West Sussex Structure Plan 2001 - 2016.

8 Cripland Close, Lindfield
Proposed extension at first floor on the rear of the property. The planning application has been discussed with adjoining residents and all, without exception, (7 in all) are horrified by the proposal to build a two storey extension, nearly double the size of the original. All residents would be overlooked by the proposed development and have written detailing their individual comments. The Council believe it is out of character with the area, and are appalled that no thought has been given to integrating it with the existing building. Recommend rejection.

Demolition of existing garaging and erection of garaging with room over.Following a further visit, it appears that though the proposed development has been set back by a few feet nothing has changed, therefore Council reiterates earlier comments that it is not in keeping with the surrounding area and rural location. Units 1-6 Pelham Farm, East Mascalls Lane, Walstead
Provision of waste skip for storage adjacent to unit 4 Pelham FarmCouncil presumes that this planning application is retrospective, as the waste skip is already in place. When Council visited the site, the waste skip was in a prominent position and overflowing; it certainly failed to enhance the appearance of the area. The Council suggests that the skip should be screened from the road and should not be open-topped.
